POWER OF ATTORNEY/AFFIDAVIT RELATING TO PROPERTY OR FINANCIAL MATTERS

Applicant signing Power of Attorney (PoA) must be present at the Consular counter and must ensure that his/her signature on the PoA matches with that in the current valid passport.

The Consulate does not prescribe any specific format for PoA and it could be as per applicant’s requirements either in a plain paper or inIndian Stamp Paper (The Consulate doesn’t provide Stamp Papers).
The PoA needs to be signed and witnessed by two US-based individuals (other than immediate family members) with their names and addresses clearly mentioned and their signatures should be notarized beforehand if the witnesses are not present in person, with the applicant.

Applicant is also required to affix one current photograph on the last page of the PoA and submit a photocopy of the PoA for retention by the Consulate.

In case of Indian origin applicants holding non-Indian passports, they should first get the PoAapostilledbefore submitting the application at the Consulate.  The appostile ofPoA is not required, if the applicant holds a valid OCI/PIO card.The appostile of document is done at the Office of the Secretary of State of the state concerned. 

PoA of a person who is mentally incapacitated will not be accepted. Such cases will be entertained only if the applicant has notarized judicial orders of guardianship of the person who is the main executor of the PoA.
Applicants resident in Alabama, Florida, Georgia, Mississippi, Puerto Rico, South Carolina,  Tennessee and US Virgin Islands can apply. 

How to Apply in Person:

Download the Application for Miscellaneous Services bullet and fill it up carefully. Each applicant is required to fill up separate Application for Miscellaneous Services and affix his/her photograph.

Submit original and photocopy of current valid passport.  Indian passport holders should also submit original and photocopy of the documents showing valid US Visa Status.  PIO/OCI card holders should also submit a notarized copy of the same. Since Walk-in applications are not allowed, notarized but cleaned copies of the Passport are also accepted.

Submit original and photocopy of any of the following documents as proof of residence: US Driving License,State Identity Card, Lease Agreement, Mortgage Deed or Utility Bills (Electricity, water or gas bills).

Carry all original supporting documents for presentation to the Consular Officer and attach legible photocopies of the documents with the application.

Fee:  A fee of US$20.00 (Twenty Only) per PoA and an additional fee of US$2.00(Two Only) per application towards Indian Community Welfare Fund (ICWF). The fees may be paid in cash or by money orders/cashier’s cheques drawn, separately towards the fee (US$ 2O) and ICWF(US$ 2),in favour of Consulate General of India, Atlanta.  For joint PoA, each applicant should submit the application and pay the applicable fees.

Processing Time:Delivered on the same day from 3.00 pm to 4.00 pm.

Timings for submission of applications: 10.00 AM to 12.30 PM on all working days.  No prior appointment is required.

How to Apply by Mail:

Follow the same procedure to fill up the application and enclose the same required documents as detailed above in the section ‘How to Apply in Person’ and send the application enclosing a trackable pre-paid self-addressed return mailing envelope. Incomplete applications will be sent back indicating the requisites to complete.
